Legalization of Marijuana and the Impact on the Workplace – what you need to know!

Seminar Description
- What does the impending legalization of marijuana mean for Canadian workplaces? This session will consider the impacts legalization will have on the workplace, including those of a safety-sensitive nature, and discuss employers’ rights and employees’ obligations and the implementation/revision and application of workplace policies in response to legalization.
- While legalization may currently be the more prevalent media topic, the more challenging topic for employers to effectively address is medical marijuana. This session will discuss the meaning of “medical marijuana”, its impact on the workplace, an employer’s (sometimes conflicting) duties to accommodate and to provide a safe work environment and employees’ obligations to attend work fit for duty. A refresher on the duty to accommodate disabilities, including drug and alcohol addictions, pursuant to human rights legislation will be included.
- Organizations engaged in the provision of recruitment and/or temporary staffing services are uniquely situated given the relationships such organizations have with the clients they serve and with prospective temporary and permanent placements. This session will include consideration of the potential risks that exist in relation to temporary and permanent staffing (and internal employees) and issues relating to drug use, including drug addictions and accommodation, and potential ways to mitigate those risks.
About the Speaker:
Shandra is a partner at MLT Aikins LLP where she provides practical and strategic advice on all matters relating to labour, employment and human rights law to management of public and private sector organizations across a variety of industries. As part of this, she represents employers in collective bargaining and before arbitration boards, human rights commissions and tribunals, labour boards, workers compensation tribunals and Manitoba courts. Shandra has been listed in the 2009 - 2018 editions of Best Lawyers International for Labour and Employment Law and was recognized by Lexpert Magazine in 2013 as one of Canada’s leading lawyers under 40. She is a former member of the Board of Directors of the Canadian Association of Counsel to Employers, CPHR Manitoba and her children’s former daycare and co-chair of the Professions Division for the United Way Winnipeg Campaign Cabinet and current member of the Winnipeg Chamber of Commerce.
